0. Definitions

"Services" refers to all websites, mobile apps, browser extensions, APIs, and associated tools provided by DFend.
"DFend ID" means your unique identifier for accessing and managing linked digital accounts."
You" refers to the individual accessing or using the Services.
"We" / "Us" / "DFend" refers to DFend, Inc.


1. Overview

DFend provides digital identity protection tools including encryption, monitoring, threat detection, remediation, secure storage, and other privacy and security capabilities.

2. Eligibility

You must be at least 13 years of age—or the minimum age of digital consent in your jurisdiction—to use the Services. By accessing DFend, you affirm that you meet this requirement and have the legal authority to accept these Terms.

2a. Account Creation and Access

Some features require you to create an account or authenticate with a third-party identity provider (e.g., Google, Apple, Microsoft). You are responsible for all activity under your account and for keeping your login credentials secure. Notify DFend immediately if you suspect unauthorized access.

3. Subscription Plans

We offer both free and paid tiers:

‍Freemium: Free access to basic tools.
‍Paid Plans: Auto-renewable monthly subscriptions (e.g., Alpha, Bravo, Charlie, Delta), with pricing displayed in-app and subject to regional availability.

By subscribing, you authorize DFend to charge your Apple ID or Google account. Subscriptions automatically renew unless canceled at least 24 hours before the renewal date. You may cancel at any time through your App Store settings. No refunds are issued for partial periods unless required by law.

DFend may update pricing or plan features at any time, with advance notice provided via app, email, or other contact methods. Continued use after pricing changes constitutes acceptance.

4. Data Privacy and Security

We process personal data in accordance with our Privacy Policy and comply with applicable laws (e.g., GDPR, CCPA, LGPD). Data is encrypted in transit (TLS 1.3) and at rest (AES-256). We do not sell personal data.You may access, correct, export, delete, or limit your data based on your jurisdiction. For more information, review our Privacy Policy or contact us at hello@dfend.app.

5. Third-Party Services

DFend integrates with third-party providers such as cloud storage, payment processors, and social login tools. These services are subject to their own terms and privacy policies. DFend is not responsible for their actions or failures.

6. Billing, Renewal, and Cancellation

All payments are processed via Apple or Google in-app purchase systems. You must cancel through your device's App Store settings. Access remains active until the end of the billing cycle.Auto-renewals will continue unless canceled at least 24 hours prior to renewal. DFend reserves the right to change pricing, with advance notice. No refunds are issued unless required by law.

7. Legal Compliance and User Conduct

You agree to comply with all applicable laws and regulations. You agree not to:

Misuse or interfere with the Services;
Engage in fraudulent or illegal activity;
Attempt to reverse-engineer or hack the platform;
Circumvent any security or access restrictions.

8. Limitation of Liability

To the maximum extent allowed by law, DFend is not liable for indirect, incidental, special, or consequential damages, including loss of data, profits, or security breaches caused by user negligence.

DFend’s total liability is limited to the amount paid by you to DFend in the past 12 months, if any.

9. Indemnification

‍To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless DFend, Inc., its affiliates, subsidiaries, officers, directors, employees, contractors, agents, licensors, suppliers, and service providers (collectively, the “Indemnified Parties”) from and against any and all claims, demands, liabilities, damages, judgments, losses, costs, expenses, and fees (including reasonable attorneys’ fees and costs) arising out of or relating to:

- Your access to or use of the Services, including any misuse or unauthorized use;
- Your breach or violation of these Terms of Service, the End User License Agreement (EULA), or any applicable law or regulation;
- Any content or data you submit, upload, transmit, or otherwise make available through the Services;
- Your violation of the rights of any third party, including but not limited to intellectual property, privacy, or data protection rights;
- Your use of third-party services or integrations through or in connection with the Services;
- Any claim that your conduct caused damage to a user, third party, or DFend’s reputation, operations, systems, or security.

DFend reserves the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate fully in the defense of any such claim. You shall not, in any event, settle any matter without the prior written consent of DFend.

10. Termination

We may suspend or terminate your account for violations of these Terms, suspected abuse, or as required by law. Upon termination, access is revoked and data will be deleted within 30 days unless retained for legal or security purposes.

11. Dispute Resolution and Arbitration

If you are located in the U.S., you agree to resolve disputes through binding individual arbitration. You waive the right to class actions and jury trials. Jurisdiction for any disputes not subject to arbitration will be in New York, NY. If arbitration is not enforceable in your jurisdiction, your local consumer laws may apply.

12. Modifications to Terms

‍We may update these Terms periodically. Material changes will be communicated via email or in-app notifications. Continued use after updates constitutes your acceptance.

13. Beta Features Disclaimer

‍From time to time, DFend may offer features in beta or experimental form. These features are provided “as is,” may be discontinued at any time, and carry no warranties or guarantees of performance, availability, or security. Use them at your own risk.

14. Community Guidelines and User Content

‍If the Services allow users to post comments, submit content, report fraud, or contribute data:

- You are solely responsible for any content you post.
- You agree not to post harmful, misleading, illegal, or infringing content.
- DFend reserves the right to remove any content at its sole discretion.

We may terminate or suspend your access for violating these rules.

15. Force Majeure

‍DFend is not responsible for any failure or delay in performance due to events outside our control, including but not limited to:

- Acts of God;
- Natural disasters;
- Cyberattacks;
- War or terrorism;
- Internet or infrastructure failures;
- Government actions or orders.

16. Export Control Compliance

‍You agree to comply with all applicable U.S. export control laws and regulations. You represent that:

- You are not located in a country subject to U.S. sanctions;
- You are not listed on any U.S. government denied-party list;
- You will not use or export the Services for prohibited uses (e.g., nuclear, missile, or chemical weapons activities).

17. App Store-Specific Terms

‍If you downloaded the DFend app through the Apple App Store or the Google Play Store, the following applies:

- Subscriptions purchased through the App Store are billed through your Apple or Google account.
- Cancellation or refunds must be handled through the respective app store per their policies.
- Apple and Google are not responsible for the functionality or support of the Services.

18. Entire Agreement

‍These Terms, the Privacy Policy, and the EULA represent the entire agreement between you and DFend, Inc..
No oral or written statement by any party shall modify these terms unless explicitly updated in writing by DFend.
